RE: Letter of Claim — Ms Adaeze Okafor (our client) v your insured, Mr D. Harding
Road traffic collision on 12 June 2026 · Vehicle BMW 320d, reg. LR21 KMX
We are instructed by the above-named claimant in respect of a road traffic collision that occurred on the date stated above. This letter is sent in accordance with the Pre-Action Protocol for Low Value Personal Injury Claims and the Protocol for Personal Injury Claims. Please treat it as a formal letter of claim.
Liability rests entirely with your insured, who collided with the rear of our client's stationary vehicle at Deansgate, Manchester. We note liability has been admitted under your reference above and we now write to particularise our client's losses.
Liability is denied by your insured. Our client's account is that your insured collided with the rear of her stationary vehicle at Deansgate, Manchester. We invite you to confirm your position on liability within 21 days, failing which we reserve the right to issue proceedings without further notice.
Circumstances
Our client was stationary in slow-moving traffic when your insured's vehicle, a Vauxhall Astra (reg. BV18 NYU), failed to stop and struck the rear of her vehicle. The impact caused substantial damage and our client has been deprived of the use of her vehicle since the date of loss.
Heads of loss
- Vehicle damage — total loss. Our independent engineer has assessed the vehicle as beyond economic repair, with a pre-accident value of £14,250.00 less salvage. The engineer's report is enclosed.
- Credit hire charges. Our client's vehicle was essential for her employment and she required a replacement on credit hire terms. Charges to date stand at £3,528.00 (42 days at £84.00 per day) and continue to accrue pending settlement.
- Recovery & storage. Recovery of the vehicle from the scene and subsequent storage charges amount to £620.00, invoiced and enclosed.
- Personal injury (reserved). Our client reports soft-tissue injury to the neck and shoulder. A medical examination has been arranged and a reserve of £5,000.00 is recorded pending the medical report, which will be served upon receipt.
- Policy excess. Our client has paid a policy excess of £250.00, which we claim in full.
The total value of the claim presently stands at £23,648.00, subject to the medical evidence and continuing hire. A full schedule of loss is enclosed.
We look forward to your acknowledgement within 21 days and your substantive response within the protocol period of three months. Should you fail to respond, our client reserves the right to issue court proceedings without further reference to you.
